§ 1

Hereinafter referred to as the Contractor.

§ 2

A customer of the online store, hereinafter referred to as the Purchaser, may be a legal entity or a natural person of legal age. The Purchaser must have full legal capacity to enter into legal transactions.

Conclusion of the Agreement

§ 3

The parties agree that the place of order fulfillment is the online store operated by Bartłomiej Popielas FLOW, ul. Młynarska 24/6, 91-823 Łódź, Poland.

§ 4

The Contractor declares that the products presented on the website www.tedgar.pl do not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but constitute an invitation for Purchasers to submit offers.

§ 5

  1. To place an order, the Purchaser must complete a one-time user registration. Each product includes an “add to cart” option, which must be selected along with the desired quantity. The shopping cart may contain any number of different products and can be modified at any time by adding or removing items.
  2. Order processing begins after acceptance of the cart contents and submission of the required order details. The Purchaser is responsible for the accuracy of the provided information.
  3. The Purchaser is required to provide all information marked as mandatory for order fulfillment and is responsible for its correctness.
  4. The Contractor reserves the right to refuse orders that are incorrectly completed.

§ 6

  1. Information and data presented on www.tedgar.pl are based on the current product assortment and availability. Product images are for illustrative purposes only, and differences may occur between images and actual product labels or descriptions.
  2. Due to the unique nature of certain products, order fulfillment times may be extended. In such cases, the Purchaser will be informed of the nearest possible fulfillment date. The Contractor reserves the right to cancel orders without providing a reason and to change prices, with prior notification to the Purchaser.
  3. The Contractor is obligated to accept and confirm an order within 24 to 48 hours of receipt, excluding weekends and public holidays. After this period, the Purchaser is no longer bound by the order unless otherwise stated. The agreement is deemed concluded at the moment the Contractor confirms acceptance of the Purchaser’s offer.

Delivery Costs and Times

  1. Polish Post – Priority Mail (for shipments up to 200 ml):
    • Price: PLN 8.50 net
    • Minimum weight: 1 ml
    • Maximum weight: 201 ml
    • Delivery time: 2–6 days from payment confirmation
  2. DPD Courier:
    • Price: PLN 16.00 net
    • Minimum weight: 1 ml
    • Maximum weight: 30,000 ml
    • Delivery time: up to 3 days from payment confirmation

Payment and Product Collection

§ 7

  1. The product is deemed delivered upon transfer of the ordered goods to the carrier (courier company) or to an employee of the Contractor authorized under a contractual agreement. In the case of shipment, the Purchaser authorizes the carrier or the Contractor’s employee to collect the goods on their behalf.
  2. Accepted payment methods include:
    • Bank transfer
    • PayPal transfer
    • Bank transfer or card payment via PayU
  3. The person delivering the ordered goods has the right to verify the Purchaser’s identity by inspecting an identification document.

§ 8

  1. The Purchaser is obliged to pay the price for the ordered products.
  2. All prices listed on the website are expressed in Polish currency (PLN) and include VAT.
  3. Delivery charges, if applicable, are added to the product price and automatically calculated in the order form after the Purchaser selects the delivery method.

§ 9

The Purchaser is required to pay for the ordered products via bank transfer to the store’s designated bank account or in another previously agreed-upon form.

Returns and Complaints

§ 10

  1. The Contractor accepts returns in cases where the delivered product does not conform to the order.
  2. Warranty claims are accepted only in justified cases. Complaints must be submitted in writing or by email and will be reviewed within 7 days from the date of submission or receipt of the returned goods.
  3. Refunds are available only for unopened and undamaged products.
  4. A receipt or invoice must be included with the returned product.
  5. A Purchaser who is a consumer has the right to withdraw from the contract within 14 days of receiving the ordered goods, provided the returned product is unused and undamaged.

Personal Data

§ 11

  1. The Purchaser consents to the inclusion of their personal data in the store’s database and to its processing for marketing, informational, and contract fulfillment purposes. Providing personal data and consent for its processing are necessary to complete the order. The Purchaser is responsible for providing accurate personal data. Withdrawal of consent requires written form.
  2. Personal data is protected in accordance with the Act of August 29, 1997, on the Protection of Personal Data, in a manner preventing access by unauthorized third parties.
